Subject:-Anti-Dumping investigations concerning imports of Paracetamol from China PR and Chinese Taipei – Amendment to final finding notification 60/1/2000-DGAD dated 22nd January 2002.

No.60/1/2000-DGAD - Having regard to the Customs Tariff Act, 1975 as amended in 1995 and the Customs Tariff (Identification, Assessment and Collection of Anti-Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 the Designated Authority recommended Anti Dumping Duty in respect of imports of Paracetamol from China PR and Chinese Taipei (based on official statistics of imports) vide its Final Findings notified vide Notification No. 60/1/2000-DGAD dated the 22nd January 2002 and Anti Dumping Duty was notified by the Central Government vide notification No 29 dated 27th March 2002. Whereas it has been brought to the notice of the Designated Authority that no import has taken place of the subject goods from Chinese Taipei during the period of investigation (1st April 1999 to 30th September 2000). Subsequently, all the interested parties were informed vide Notice dated 21st April 2005 about the confirmation that no imports of Paracetamol had taken place from Chinese Taipei and it was informed that the Authority proposes to withdraw the anti dumping duty imposed on imports of Paracetamol from Chinese Taipei by amending the relevant notification.
Whereas no replies/comments were received from any of the interested parties within the specified time. In view of the foregoing, para 9 & 10 of the Final Findings notified vide Notification No. 60/1/2000-DGAD dated the 22nd January 2002 stands amended as under:
9. Final Findings:-
The Authority after considering the foregoing concludes that:
a. Paracetamol originating in or exported from China PR has been exported to India below normal value resulting in dumping;
b. The domestic industry has suffered material injury;
c. Injury has been caused by the imports from China P.R.
10. The Authority recommends imposition of definitive Anti-dumping duty on all imports of Paracetamol originating in or exported from China P.R. falling under Customs Sub-heading No. 2922.2914 of the Customs Tariff Act. The anti dumping duty shall be the difference between the amount mentioned in column 3 and the landed value of imports.
