Subject:- Initiation of anti-dumping investigation concerning import of Bisphenol-A from the United State of America.
No. 37/ADD/IW/95- In accordance with Rule 7(1) of the Customs Tariff (Identification, Assessment and Collection of Duty or Additional Duty on Dumped Articles and for Determination of Injury) Rules, 1985 an anti-dumping investigation to determine the existence, degree and effect of alleged dumping of Bisphenol-A originating from Russia and Brazil was initiated vide notification No. 9/11/94-ADD dated 30th December, 1994. The petition was filed by M/s. Kesar Petroproducts Ltd., 7, Nagin Mahal, 2nd Floor, 82 Veer Nariman Road, Churchgate, Bombay-400 020.
2. The product Bisphenol-A is an organic chemical and is manufactured out of Phenol and Acetone. It is used for the manufacture of Epoxy Resins which is an important input in paint industry and polycarbonates. Bisphenol-A classified under the Customs Tariff code 29072300 (Harmonized system), falls under open general licence category.

During the course of above referred investigation, it was observed from the published data indicating the prices obtained from the suppliers in USA that the domestic price of the product in USA has increased from USD 0.87per lb (April 1993 to March 1994) to USD 1.64 per lb (about USD 3600 per MT) during April-May, 1994. Inspite of increase in domestic price of the product in USA, the CIF export price to India were reduced from an average of USD 750 per MT (1993-94) to about USD 650 per MT in April- September 1994. The export price being much lower than the domestic price prima facie establishes dumping of Bisphenol-A by USA exporters.

It is observed from the import statistics compiled by an Indian agency that the import from USA have increased steeply from 83 MT in 1992-93 to 196 MT in 1993-94 and above 300 MT in six months period of April-September, 1994. The weighted average CIF export price has declined from Rs. 27.34 per kg. in 1992-93 to Rs. 23.82 per kg in 1993-94 and Rs. 20.78 per kg in the six months period of April-September 1994, which alongwith the dumped imports for Russia and Brazil has forced the Indian industry to keep its selling prices to unremunerative level resulting in huge losses.
5. There is a prima facie evidence that imports of Bisphenol-A originating from United States of America are at dumped prices and are causing material injury alongwith dumped imports originating from Russia and Brazil to the Indian Domestic industry.
6. I am, therefore, initiating anti-dumping investigation into the existence, degree and effect of alleged dumping of Bisphenol-A originating from United States of America in accordance with Rule 5(4) of the Customs Tariff (Identification, Assessment and Collection of Anti Dumping Duty on Dumped Article and for Determination of Injury) Rules, 1995.
7. The domestics industry in India producing the like goods, exporters in United States of America, and importers in India known to be concerned are being addressed separately to make their views known in the form and manner prescribed so as to reach me within 40 days of the date of this Notification at the following address.
